Welcome to Brackettup HealthTech Private Limited (“Brackettup,” “we,” “us,” or “our”). By accessing or using our platform and services, you agree to these Terms and Conditions (“Terms”). Please read them carefully.

1. Acceptance of Terms

By accessing Brackettup’s website, app, or services, you agree to comply with these Terms. If you do not agree with any part of the Terms, please refrain from using our services.

2. Description of Services

Brackettup provides an online platform for users to book health and wellness services, such as yoga sessions, fitness classes, and spa treatments, offered by third-party providers (“Service Providers”).

3. User Responsibilities

You agree to use Brackettup’s platform responsibly and adhere to the following guidelines:

• Eligibility: You must be at least 16 years old to use Brackettup. If you are under 18, you may use our services only with parental consent.
• Account Information: You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
• Accurate Information: You agree to provide accurate and up-to-date information during registration and service bookings.
• Respectful Conduct: Harassment, abuse, and inappropriate behavior towards Service Providers or other users are strictly prohibited.

4. Booking, Payment, and Wallet Transfers

All bookings and payments made through Brackettup are subject to the following terms:

• Booking Confirmation: Once a booking is completed, you will receive a confirmation. Brackettup does not guarantee availability until the booking is confirmed.
• Payments: Payments for services are processed through our authorized payment gateway. You agree to pay all fees associated with the services you book.
• Wallet Transfer Options: Organizations can manually transfer funds from their Brackettup wallet to their bank account with a bank transfer fee of ₹10. However, a complete settlement of wallet funds to the organization’s bank account is conducted every Sunday, free of any transfer fees.

5. Refunds and Cancellations

Refunds and cancellations are subject to the following conditions:

• User Cancellations:
  • If a class is canceled by the user at least 4 hours before the scheduled start time, the user is eligible for a full refund.
  • If a class is canceled within 4 hours of the scheduled start time, the amount will not be refunded. Instead, it will be credited to Brackettup’s account.
• Service Provider Cancellations: If a class is canceled by the business/organization 1 hour before the scheduled start time, the organization will incur a penalty equal to 30% of the per-activity class fee per user. This penalty amount may be applied as a discount to users, depending on Brackettup’s decision.

6. Disputes and Money Holds

• Dispute Resolution: In cases of transaction disputes, Brackettup reserves the right to hold funds until the dispute is resolved. Funds may be withheld from being credited to the organization’s wallet if a dispute is active.
• Delayed Wallet Credit for Activities: For any activity class, the payment will be available for credit in the organization’s wallet 5 days after the class date, subject to any dispute. Brackettup reserves the right to hold funds in cases of disputes.

7. Service Providers

Brackettup does not directly provide health and wellness services. The services are offered by independent Service Providers, and Brackettup acts solely as a booking platform.

• Service Responsibility: Service Providers are solely responsible for the quality, availability, and delivery of the services. Brackettup is not liable for any issues that arise during or after a service session.
• Service Provider Policies: Each Service Provider may have their own policies regarding refunds, cancellations, or modifications. Brackettup encourages users to review these policies prior to booking.

8. User Conduct and Prohibited Activities

You agree not to engage in the following activities on Brackettup:

• Posting or transmitting any content that is offensive, defamatory, or violates the rights of others.
• Misusing or attempting to interfere with the security or functionality of the platform.
• Attempting to access another user’s account without authorization.

9. Intellectual Property

All content, trademarks, logos, and other intellectual property on Brackettup’s platform are owned by Brackettup or licensed to us. You are prohibited from using any of our intellectual property without prior written permission.

10. Disclaimer of Warranties

Brackettup provides the platform on an "as-is" and "as-available" basis. We make no warranties regarding the accuracy, availability, or reliability of the services provided through our platform.

Health Disclaimer: Brackettup does not endorse or verify the qualifications of Service Providers. You are responsible for determining if the service is appropriate for your needs.

11. Limitation of Liability

To the fullest extent permitted by law, Brackettup shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, use, or profits, arising out of or in connection with your use of the platform.

12. Changes to These Terms

Brackettup reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on our platform, with an updated “Last updated” date. Continued use of the platform after such changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms and any disputes related to them are governed by the laws of India. You agree to submit to the jurisdiction of the courts located in [Insert City, e.g., New Delhi] for the resolution of any disputes.
